End-user licence agreement

1. Agreement

This End User Licence Agreement governs use of ASITTECH software. By installing, activating or using the software, the licensee agrees to this EULA, subject to mandatory rights under applicable law.

2. Licensor

The software is licensed by ASITTECH / AS Data Recovery, operated by Srinivasan, Proprietor.

3. Licence Grant

Subject to payment and compliance with this EULA, ASITTECH grants the customer a limited, non-exclusive licence to use the purchased software for an initial period of one (1) year. Continued use after the initial one-year term requires renewal. The standard renewal fee is 60% of the then-applicable purchase price of the relevant licence, unless otherwise stated on the product page or renewal quotation.

4. Activations

The licence permits activation and use on the number of computers/devices stated for the edition purchased (one for the Professional edition) at any one time during the applicable licence term.

5. Transfer

The licence may be transferred to a replacement computer/device. The customer may be required to deactivate the previous installation or contact ASITTECH for an activation reset. Use on more computers/devices than the edition permits is not allowed. The transfer does not extend or reset the licence term.

6. IT Companies and Technicians

Where the edition purchased permits commercial recovery services (such as the Enterprise edition), an IT company, technician or professional recovery provider may use the software to recover data for its customer, provided that the operator has lawful authority to access the customer's data/media and complies with this EULA. The licence does not transfer ownership of the end customer's data to ASITTECH.

7. Authorized Data Access

The licensee represents that it has the legal right and authorization to access, copy, analyze, repair or recover the data and storage media on which the software is used.

8. Trial and Evaluation

If a trial version is offered, the trial may be subject to separate limitations, duration or functionality described at the time of download. Trial use does not create ownership rights.

9. Updates and Support

A one-year licence includes updates and support only to the extent stated for the product. Updates and support after the initial term require renewal of the licence.

10. Restrictions

• Do not share, publish or distribute licence keys except as expressly authorized.
• Do not sell, rent, sublicense or redistribute the software except where expressly authorized.
• Do not circumvent activation or security mechanisms.
• Do not use the software to access data or media without lawful authorization.
• Do not remove proprietary notices.
• Do not reverse engineer, decompile or disassemble except to the extent that applicable law expressly permits such activity and the restriction cannot legally apply.

11. Intellectual Property

The software, source code, documentation, trademarks, interfaces and related intellectual property remain the property of ASITTECH / its licensors. This EULA grants a licence, not ownership.

12. Recovery Results

The software is a technical recovery and repair tool. Successful recovery depends on the condition of the media, file system, database, encryption, overwriting, corruption and other factors. ASITTECH does not guarantee a particular recovery result unless expressly agreed in writing.

13. Warranty Disclaimer

To the extent permitted by law, the software is provided subject to the product documentation and without an unconditional guarantee that it will meet every requirement or recover every file. Mandatory statutory warranties are not excluded where they cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, ASITTECH will not be liable for indirect, incidental, special or consequential loss arising from use of the software. Nothing in this clause limits rights under mandatory law or any applicable written agreement.

15. Termination

ASITTECH may terminate or suspend a licence for material breach, fraud, unauthorized distribution, activation abuse or unlawful use, subject to applicable law. Upon termination, the customer must stop using the software and remove unauthorized copies.

16. Export and Sanctions

Customers must comply with applicable export-control, sanctions and trade laws. ASITTECH may restrict transactions where required by applicable law.

17. Governing Law

This EULA is governed by the laws of India. Subject to any mandatory rights of consumers under applicable law, the courts at Dharmapuri, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or relating to this EULA or the software.
